Terms and Conditions

Procedure: The property shall be sold subject to the seller’s or sellers’ confirmation of the final bid for individual tracts, a combination of tracts, or the entire offering at the conclusion of the bidding process.

Down Payment: A 10% down payment is required on the day of the auction, with the balance due at closing within 30 days or less. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING. Be sure you have arranged financing, if needed, and are capable of paying the balance at closing.

Title: Title search, preparation, and title insurance costs shall be divided equally between the buyer and seller.

Possession: Possession will be given at closing within 30 days or less.

Mineral Rights: The sale shall include 100% of the mineral rights owned by the sellers.

Auction Method: The real estate will be sold by the total dollar amount. Property 1 will be sold on-site at 10:00 A.M., followed by Property 2, which will be sold on-site at 1:00 P.M.

Easements: The sale of the property is subject to any and all easements of record.

Taxes: The 2026 Monroe County property taxes will be prorated to the date of closing.

Survey and Acreage: The properties will be sold using their legal descriptions. All acreages are approximate and accurate to the best of our ability based on assessor’s maps, measurements, and legal descriptions. Any survey required by the purchaser to obtain financing or close the agreement shall be paid for by the purchaser.

Closing: The anticipated closing date shall be on or before Friday, November 13, 2026, or on a date mutually agreed upon by the buyer(s) and sellers. Closing will be conducted at the office of Monroe County Abstract, 229 N. Main St., Paris, MO 65275.
